Night differential pay in the Philippines, explained

Night differential applies to covered work inside a defined night window. Exact timestamps, breaks, day type, and overtime status matter more than the shift label.

The statutory night window is 10 p.m. to 6 a.m.

DOLE guidance describes night shift differential as additional compensation for each hour of work performed between 10 p.m. and 6 a.m. for covered employees. The statutory floor commonly used is at least 10% of the regular wage for each covered hour.

A schedule called “night shift” is not enough. A 6 p.m. to 2 a.m. shift contains both daytime and night-window hours, while a 4 a.m. to noon shift contains only the portion from 4 a.m. to 6 a.m. inside the statutory window.

Calculate the covered hours from timestamps

Write the shift as a timeline, including an overnight end time on the following day. Count only working minutes between 10 p.m. and 6 a.m. Then remove the actual unpaid break if its timing is known. A calculator that only knows total break minutes may have to allocate the break approximately.

Minute-level records avoid rounding every partial hour independently. After summing eligible minutes, convert to hours for the pay calculation according to the employer’s lawful timekeeping policy.

Ordinary-night pay example

Assume a covered ordinary hourly rate of ₱150 and four eligible night hours on an ordinary workday. The estimated night-differential premium is ₱150 × 10% × 4 = ₱60. The ordinary pay for those hours is separate; total pay for the four hours would reflect the base plus the premium.

If a company policy grants 15%, the more favorable company rate may apply. Kasyafi’s standalone statutory illustration defaults to 10% unless the tool explicitly offers another valid rate context.

Overtime, rest days, and holidays change the effective base

When night hours are also overtime or fall on a premium day, the night differential is calculated on the applicable pay for that work context. For example, the night premium on ordinary-day overtime is tied to the overtime-adjusted rate, not simply 10% of the unadjusted ordinary hourly wage.

A shift crossing midnight can also cross from one legal day classification to another. Split the timeline when the calendar day, rest-day status, or holiday changes, then apply each segment’s rule.

Coverage and company policy still matter

Not every worker is covered identically by the Labor Code rule, and sector-specific or company arrangements can be more favorable. Confirm the employment classification, contract, collective agreement, and employer night-work policy.

A payroll label such as “night allowance” may be additional to, or intended to represent, the statutory premium. Ask for the formula rather than deciding from the name alone.

Audit the premium from the time record

Match the cutoff, segment the night-window hours, remove actual unpaid breaks, identify overtime and day premiums, apply the correct rate, and compare the total with every related payslip line. This sequence isolates whether the difference is in time, base rate, multiplier, or classification.

Does the whole shift receive night differential if it ends after 10 p.m.?

No. The statutory calculation covers eligible work actually performed within 10 p.m. to 6 a.m., not automatically the whole shift.

Is a meal break included?

An unpaid break is generally not working time. Use its actual timing when known; an estimated proportional break allocation can differ from payroll.

What if company policy pays 15%?

A more favorable valid company or collective-agreement benefit may apply. The statutory floor does not prevent a higher contractual rate.
